SUMMARY OF PROVISIONS: Section 1. Paragraph (h) of section 339-v the real property law is amended to allow for meetings of unit owners to be held via electronic means if determined by the board of managers. Section 2. Effective Date
JUSTIFICATION: The New York State Condominium Act allows each condo board to set its own bylaws dictating how meetings of the unit owners are to be held. During the COVID-19 pandemic, due to restrictions on in-person gath- erings, many condo hoards had to shift to holding meetings electron- ically on software like Zoom and Skype. As the COVID-19 pandemic comes to an end, many condo hoards have expressed interest in maintaining electronic meetings. This bill would allow a Board of Managers for condominiums to authorize the continuation of electronic meetings with- out needing to change the by-laws. Similar legislation has already been enacted to allow for cooperative buildings to hold remote meetings. PRIOR LEGISLATIVE HISTORY: New Bill FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None EFFECTIVE DATE: This act shall take effect immediately.
